DMCA Policy
[Your Company Name for Commercial Property Insurance] ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our services that are reported to our Designated Copyright Agent, identified below.
This policy describes the information that should be present in a DMCA Notice and a Counter-Notification. It is designed to make the process of reporting and counter-reporting alleged copyright infringement as straightforward as possible, while also reducing the number of notifications that we receive that are fraudulent or difficult to understand.
Filing a DMCA Infringement Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our website by completing the following DMCA Infringement Notice and delivering it to our Designated Copyright Agent.
- Identification of the Copyrighted Work: Identify the copyrighted work that you claim has been infringed. Provide sufficient detail, such as the title of the work, and if possible, a URL or other reference to where the copyrighted work can be found online.
- Identification of the Infringing Material: Identify the material that you claim is infringing, including its precise location on our website (e.g., specific URL or other identifying information that allows us to locate the material).
- Contact Information: Provide your contact information, including your full legal name, mailing address, telephone number, and email address.
- Statement of Good Faith Belief: Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- Statement Under Penalty of Perjury: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or Physical Signature: Provide your electronic or physical signature.
Once a complete and valid DMCA Infringement Notice is received, we will take whatever action, in our sole discretion, we deem appropriate, including removal or disabling of the challenged content from the website.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. Your counter-notification must include the following:
- Identification of Material: Identify the specific content that was removed or disabled and the location (URL) at which the content appeared before it was removed or disabled.
- Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your Contact Information: Your name, address, and telephone number.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which [Your Company Name] may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
